The 'Illegal Immigration Reform and Enforcement Act of 2011 "expands Georgia E-Verify requirement and current phase of the use of E-Verify mandatory for many private businesses through the following approach:
Private employers in Georgia with 500 employees or more must use E-Verify for new hires later than January 1, 2012. Private employers in Georgia with 100 employees or more but less than 500 must use E-Verify for new hires later than July 1, 2012. Private employers in Georgia with between 11 and 99 employees must use E-Verify for new hires later than July 1, 2013.private employers in Georgia with 10 employees or less are exempt from the law.The law, which passed both houses of the Legislature of Georgia by an overwhelming majority, will also expand police powers to investigate immigration status of suspects, penalize those who transport or harbor illegal immigrants, and make it a crime to use fake identification to obtain employment.
"The use of E-Verify means everybody plays by the same rules - and it protects employers by giving them a federal stamp of approval of their workforce," said Governor Deal in the News press."It also protects workers because those who live in the shadows of our society lacks legal protection and are vulnerable to fraud and abuse."
E-Verify is a free web-based verification of the eligibility of government employees verify the information on Form I-9 against the Department of Homeland Security (DHS) and Social Security Administration (SSA) bases data. A December 2010 report of the United States Government Accountability Office (GAO) showed that E-Verify immediately confirmed the employment eligibility of nearly 97.5 per cent 8.2 million new recruits entered the system during fiscal 2009.
An E-Verify designated agent of employer control over the use of resources (ESR) - a background check provider accredited by the National Association of database administrators sieving (NAPB ®) - may help employers comply to Form I-9 and E-Verify requirements.
